CAMCORDER RENTAL AGREEMENT

This Camcorder Rental Agreement (“Lease”) is made effective by initialing or signing any part or pages in this form between the Renter and Press Record LLC. By initialing or signing this form, the user agrees to be bound by this Camcorder Lease Agreement and all the Terms and Conditions therein, whether the user has read them or not. Press Record LLC may at any time and by its sole discretion modify this Camcorder Rental Agreement and all the Terms and Conditions therein. By initialing or signing any part of this form, the Renter indicates acceptance of the modified Terms and Conditions. This agreement is valid for as long as the renter wishes to continue renting a camcorder from Press Record LLC.

1. Intent

As a renter of another person’s movable property, you must adhere to the following Terms of Service (TOS). Should these terms not be respected, the renter will be held responsible for the costs associated with the loss or damage to the rented movable property.

You, as a renter, will be responsible for the costs associated with the loss or damage to the rented movable property if the loss or damage was caused by:

Corrosion, rust, rodents, insects, vermin, dampness of atmosphere, staining or freezing.
Artificially generated electrical currents to electrical appliances or devices (including wiring).
Attempting to fix, update, adjust or service the rented movable camcorder deemed to be damaged.
Neglect to use all reasonable means to save and preserve the rented movable camcorder at and after any disaster, or when you have notice of an impending disaster.
A criminal or willful act or omission.
Any act committed or conspired to commit with the intent to cause loss or damage to the rented movable camcorder.
Any actual or alleged spill, discharge, emission, dispersal, seepage, leakage, migration, release or escape of pollutants.
Seizure or confiscation for breach of any law or by order of any public authority

2. Disclaimer

Every effort is made to ensure that descriptions and prices are correct. Press Record LLC reserves the right to correct errors as needed. All prices and availability are subject to change without notice.

3. Lease

Press Record LLC hereby leases to Renter; Renter hereby leases from Press Record LLC, the following described Camcorder (“Camcorder”): shown in the “invoice or cart” area during checkout and reservations on our website.

4. Term

This Agreement shall commence on the date the camcorder is shipped to the Renter, which is typically 10-12 days prior to the event date. The Agreement shall remain in full force and effect until the camcorder is returned to Press Record LLC. The Renter shall return the camcorder within seven (7) days following the specified "event end date" as stated on the invoice, unless terminated earlier consistent with the terms herein.

5. Deposit and Insurance

Press Record LLC requires a deposit of 25% to secure your booking, 25% due two months before event, and the balance (50%) due one months prior to the event date. This deposit is non refundable. If the camcorder is lost, stolen, or damaged during the rental period, the Renter may not receive any footage or edited videos and will be charged a $250 fee. However, Press Record LLC offers optional insurance coverage at a fixed rate, which can protect against such incidents. If the Renter purchases this insurance, it will cover the costs associated with loss, theft, or damage, including the $250 fee.

6. Late Returns

Daily late fees of $10 per day will begin to be assessed if the camcorder is not returned within 3 days of the specified event end date. Any penalties will be charged to the Renter’s method of payment on file with Press Record LLC as we deem fit.

In the event the rental is not returned within two weeks of the due date and Press Record LLC has been unable to collect the applicable penalties, the Camcorder will be considered stolen, and the Renter’s form of payment will be charged the full replacement value of the Camcorder.
If Press Record LLC is unable to collect penalties or the replacement value of the Camcorder after two weeks, the Renter shall be considered to be in Default.
Press Record LLC reserves the right to pursue all civil and criminal remedies in the case of unreturned or lost Camcorder.

7. Use

The camcorder is provided for the exclusive use in capturing footage at personal events such as weddings, anniversaries, parties, and other celebrations. The Renter agrees to use the camcorder solely for these purposes and in compliance with all applicable laws. The Renter is strictly prohibited from using the camcorder to record any content that is illegal, obscene, or otherwise objectionable, including but not limited to illegal activities and explicit material.

Upon completion of the rental period, the Renter must return the camcorder and all included accessories in the same condition as received, using the provided return label and original packaging. The Renter is responsible for ensuring that all items are properly packed to prevent damage during transit. Failure to return the equipment in its original condition or with missing accessories may result in additional charges.

If the Renter uses the camcorder for any purpose other than those specified, or records any prohibited content, Press Record LLC reserves the right to terminate the Rental Agreement immediately, charge additional fees for any costs incurred due to misuse and pursue all available legal remedies against the Renter for any damages or losses resulting from misuse.

8. Cancellation by Owner

Press Record LLC reserves the right to cancel any order, for any reason, at any time prior to the delivery of the camcorder. This includes situations where the camcorder or necessary equipment is not available due to unforeseen circumstances, payment for the rental has not been successfully processed, or events beyond the control of Press Record LLC (such as natural disasters or strikes) prevent fulfillment of the order. Additionally, Press Record LLC may cancel if the order would require violating any applicable laws or regulations.

In the event of cancellation, the Renter will be notified promptly and any payments made will be refunded in full. The Renter acknowledges that Press Record LLC shall not be liable for any damages or losses resulting from such cancellation.

9. Ownership

The Camcorder remains at all times the sole and exclusive property of Press Record LLC. The Renter has no rights or claims to the Camcorder. Press Record LLC makes no claims to images, video, or sound recordings made by the Renter while using the Camcorder. Press Record LLC makes no claims to images, video, or sound recordings made by the Lessee while using the camcorder.

10. Damaged or Modified Camcorder

Renter shall keep the Camcorder in good condition.
Renter shall not materially modify or alter any part of the Camcorder, including hardware or software.
In the event of any form of modifications, Renter will be responsible for all reasonable costs of Leaser’s in restoring the Camcorder to its normal condition.
Renter assumes and shall bear the entire risk of damage to the Camcorder from any cause, during the term of the Lease.
Unless pre-existing damage is reported to Press Record LLC at the time of pick-up, after Renter takes possession of the Camcorder, it is assumed that any damage to the Camcorder occurred during the term of the Lease.
In the event of damage, the Renter is responsible either for replacing the item with a New Unit of the same product or paying the reasonable cost of repairs or replacement. If the item is not repairable, the Renter is liable to pay the full Replacement Value of the Camcorder.
Renter’s form of payment shall be charged the amount of repair expenses owed to Press Record LLC. If the Renter’s form of payment cannot be successfully charged within 24 hours, the Renter shall be considered to be in Default.

11. Loss of Camcorder

Renter assumes and shall bear the entire risk of loss of the Camcorder from any cause during the term of the Lease.
Lost or Stolen Camcorder – In the event that the Camcorder is reported by Renter to be lost or stolen during the term of the Lease, Renter is liable to Press Record LLC for the replacement value of the Camcorder.
Press Record LLC shall charge Renter’s form of payment the amount owed for replacement of lost or stolen Camcorder.
If the Renter’s form of payment cannot be successfully charged within 24 hours, the Renter shall be considered to be in Default.
Unreturned Camcorder – If the Camcorder is not returned within seven days of expiration of the term of the Lease, the Renter shall be liable for the replacement value of the Camcorder.
In case of a dispute over whether the Renter returned the Camcorder:
1. If Renter used alternate shipping method, not arranged in advance by the parties, and the Camcorder is subsequently lost in transit, the Camcorder is considered unreturned.
2. Owner shall charge Renter’s form of payment the amount owed for replacement of the unreturned Camcorder.
3. If the Renter’s form of payment cannot be successfully charged within 24 hours, the Renter shall be considered to be in Default.

12. Default

In the event of default, all amounts owed by Renter to Press Record LLC are immediately due.

In the event of default, Renter shall be responsible for any reasonable expenses of Press Record LLC in attempting to recover the amount owed from the Renter, including collection fees and attorney’s fees.
Press Record LLC reserves the right to pursue all available civil and criminal remedies against Renter, including but not limited to: recovering possession of the Camcorder, obtaining from Renter’s form of payment any amounts owed, hiring outside debt collection firms or private investigators, filing of criminal charges, and any civil remedies available. These remedies are not exclusive.

13. Missing Accessories

In the event of any missing accessories from the camcorder, the Renter is fully liable to Press Record LLC for the replacement cost of the missing items.

14. Liability

Press Record LLC shall not be liable for any loss or damage to the footage captured by the Renter, except in cases where such loss or damage is directly caused by Press Record LLC's negligence or technical failure. In the event that footage is lost due to technical issues or mishandling by Press Record LLC, the Renter shall be entitled to a full refund of the rental fee and any editing services paid for.

However, if the loss or damage to the footage is caused by the Renter's actions, including but not limited to improper use of the camcorder, failure to follow instructions, or exposure to extreme conditions, Press Record LLC shall not be liable for any refund or compensation. In all cases, Press Record LLC's liability shall be limited to the amount of the rental fee and editing services paid by the Renter.

15. Malfunctioning Camcorder

In the case of malfunctioning Camcorder, Press Record LLC only liability to Renter is for the portion of Rent applicable to the time period that the Camcorder was non-functioning. Press Record LLC shall not be responsible for any consequential or incidental damages resulting from malfunctions.

16. Taxes or Duties

The Renter agrees to keep the Camcorder free of any taxes, duties, liens, or other encumbrances. In the event such are levied against the Camcorder, renter agrees to reimburse Press Record LLC in full for those charges.

17. Ownership

The Camcorder remains at all times the sole and exclusive property of BC Studios. The Renter has no rights or claims to the Camcorder. Press Record LLC does not have or make any claim to images, video, or sound recordings made by the Renter while using the Camcorder.

18. Shipping

Press Record LLC is responsible for covering the cost of shipping the camcorder to the Renter and for the return shipping. In the event that the camcorder is lost or damaged during transit, whether to or from the Renter, Press Record LLC will expedite a replacement package as soon as possible. The Renter must notify Press Record LLC immediately if the camcorder does not arrive or if it arrives damaged. Press Record LLC will not be liable for any delays or inconvenience caused by loss or damage in transit, but will make reasonable efforts to ensure timely delivery of a replacement.

Press Record LLC will provide tracking information for all shipments. The Renter is responsible for ensuring that someone is available to receive the package at the designated delivery address. If the package is returned to Press Record LLC due to failed delivery attempts, the Renter may be responsible for additional shipping costs to resend the package.

The Renter must use the provided return label and original packaging to return the camcorder. Failure to do so may result in additional charges for any damage or loss incurred during return shipping.

19. Severability and Governing Laws

This represents the entire agreement between Press Record LLC and Renter. If any portion of this agreement is found unenforceable, it will not affect the remainder of the agreement, which shall remain valid and enforceable. The agreement shall be enforced according to the laws of the state of Pennsylvania.

20. Acceptance of Agreement

If you place an order through our website, over the phone or physically, you automatically agree to the Rental Agreement.
