We offer this website, including all information, tools, and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies, and notices stated here. We provide a unique camcorder rental service designed to help customers capture their special moments
By visiting our site and/ or making a deposit on camcorder rental, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content.
Please read these Terms of Service carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any services. If these Terms of Service are considered an offer, acceptance is expressly limited to these Terms of Service.
We reserve the right to update, change or replace any part of these Terms of Service by posting updates and/or changes to our website. It is your responsibility to check this page periodically for changes. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes.

SECTION 1 – OUR SERVICES
By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use this site.
We provide a unique camcorder rental service designed to help customers capture their special moments. We ship our camcorders to customers approximately 10-12 days before their event, allowing them to record personal events such as weddings, anniversaries, and parties. Once the event is over, the customer ships the camcorder back to us using the original box and included return label. After receiving the camcorder, we deliver all the raw footage within 48 hours and an edited Modern Day Home Video within two weeks, providing a comprehensive and personalized video experience for you.
You may not use our products for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).
You must not transmit any worms or viruses or any code of a destructive nature.
SECTION 2 - ACCURACY, COMPLETENESS, AND TIMELINESS OF INFORMATION
We strive to ensure that all information provided on our website is accurate, complete, and up-to-date. However, we cannot guarantee that all information will always be entirely accurate or current. The customer acknowledges that any reliance on the information provided on our website is at their own risk.
We make every effort to ensure that the information about our services, including camcorder rentals and video editing, is accurate, but we are not responsible for any inaccuracies or omissions. Our website may not contain all the information necessary for every customer's specific needs, and it is the customer's responsibility to ensure they have all the necessary information before using our services. We aim to update our website regularly, but we cannot guarantee that all information will be updated in real-time.
SECTION 3 - PAYMENT
The payment terms for renting our camcorders is a $100 deposit at the time of booking to secure the rental. This deposit is paid at the time of checkout, along with the initial booking details, which include the event venue, date, shipping location and no. of camcorders needed. The balance of the rental fee is due three months prior to the event date.
Refunds are subject to our cancellation policy, which is outlined in the cancellation clause herein. Any late payments will incur late fees, the specifics of which are detailed in the Late Returns clause of the rental agreement. It is the customer's responsibility to ensure timely payment to avoid additional charges.
We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service.
We reserve the right but are not obligated, to limit the sales of our products or Services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or services that we offer. All descriptions of products or product pricing are subject to change at anytime without notice, at the sole discretion of us. We reserve the right to discontinue any product at any time. Any offer for any product or service made on this site is void where prohibited.
In the event that the camcorder is lost, stolen, or damaged during the rental period, you may not receive any footage or edited videos and will be charged a $250 fee. We offer optional insurance coverage at a fixed rate, which can protect against such incidents.

SECTION 4 - ACCURACY OF BILLING AND ACCOUNT INFORMATION
We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities rented per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the email and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders at our discretion.
You agree to provide current, complete and accurate purchase and account information for all rentals made at our website. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

SECTION 5- CANCELLATION
We reserve the right to cancel any order, for any reason, at any time prior to the delivery of the camcorder. This includes situations where the camcorder or necessary equipment is not available due to unforeseen circumstances, payment for the rental has not been successfully processed, or events beyond our control prevent fulfillment of the order. In the event of cancellation, the customer will be notified promptly via email or phone, and any payments made will be refunded in full within a reasonable timeframe, typically within 3-5 business days. You acknowledge that we shall not be liable for any damages or losses resulting from such cancellation.

SECTION 6- EXCLUSIVE USE
The camcorder provided by us is intended for the exclusive use in capturing footage at personal events such as weddings, anniversaries, parties, and other celebrations. The customer agrees to use the camcorder solely for these purposes and in compliance with all applicable laws. The customer is strictly prohibited from using the camcorder to record any content that is illegal, obscene, or otherwise objectionable, including but not limited to sexually explicit, violent, or offensive material. The customer must ensure that all use of the camcorder complies with applicable laws, including copyright and privacy laws.

SECTION 7- COPYRIGHT AND OWNERSHIP
The customer retains full ownership of all footage captured using the rented camcorder. We grant the customer a non-exclusive license to use the edited video and raw footage for personal purposes. The customer is free to distribute, display, or reproduce the footage as they see fit, without any restrictions or obligations to us.
We retain no copyright or ownership rights to the edited videos or raw footage provided to the customer. The customer owns all rights to the final edited video and raw footage, and we do not claim any intellectual property rights over these materials.
By using our services, you grant us a non-exclusive, royalty-free license to use any footage or edited videos for promotional purposes. This includes showcasing examples of our services on our website, social media, or marketing materials. We reserve the right to share the final edited videos with third parties for the purpose of promoting our services. Customer can opt out for an agreed upon fee.

SECTION 8 - USER COMMENTS, FEEDBACK AND OTHER SUBMISSIONS
If you send us specific submissions (such as testimonials or feedback about our camcorder rental services) or unsolicited creative ideas, suggestions, proposals, plans, or other materials (collectively, 'comments'), you agree that we may edit, copy, publish, distribute, translate, and otherwise use these comments without restriction. We are under no obligation to maintain confidentiality, pay compensation, or respond to comments. We may monitor, edit, or remove content deemed unlawful or objectionable. You agree that your comments will not violate third-party rights, including copyright or privacy, and will not contain libelous, abusive, or obscene material. You are responsible for the accuracy of your comments and assume all liability for them. We take no responsibility for comments posted by you or third-parties.

SECTION 10 - PROHIBITED USES
In addition to other prohibitions as set forth in the Terms of Service, you are prohibited from using the site or its content: (a) for any unlawful purpose; (b) to solicit others to perform or participate in any unlawful acts; (c) to violate any international, federal, provincial or state regulations, rules, laws, or local ordinances; (d) to infringe upon or violate our intellectual property rights or the intellectual property rights of others; (e) to harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate based on gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability; (f) to submit false or misleading information; (g) to upload or transmit viruses or any other type of malicious code that will or may be used in any way that will affect the functionality or operation of the Service or of any related website, other websites, or the Internet; (h) to collect or track the personal information of others; (i) to spam, phish, pharm, pretext, spider, crawl, or scrape; (j) for any obscene or immoral purpose; or (k) to interfere with or circumvent the security features of the Service or any related website, other websites, or the Internet. We reserve the right to terminate your use of the Service or any related website for violating any of the prohibited uses.

SECTION 11 - LIABILITY & INDEMNIFICATION
You are responsible for ensuring that the footage captured is not lost or damaged during their possession of the camcorder, including taking reasonable care to protect it from harm or extreme conditions. However, if footage is lost due to technical issues or mishandling by ourselves, we will provide a full refund of the rental fee and editing services paid for. This liability is limited to situations where our negligence or technical failure directly causes the loss or damage. The customer acknowledges that they are responsible for the safekeeping of the footage while it is in their possession, and we shall not be liable for any indirect, special, or consequential damages arising from the loss or damage of footage, except as explicitly stated above.
SECTION 12 - SEVERABILITY
In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.

SECTION 13 - TERMINATION
The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes.
These Terms of Service are effective unless and until terminated by either you or us. You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our Services, or when you cease using our site.
If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof).

SECTION 14 - ENTIRE AGREEMENT
The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.
These Terms of Service and any policies or operating rules posted by us on our website or in respect to The Service constitutes the entire agreement and understanding between you and us and govern your use of the Service, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms of Service).

By using our services including renting camcorders and receiving video editing services, you agree to be bound by these Terms and Conditions. The customer acknowledges that they have read, understand, and agree to these terms and conditions, whether or not they have read them in full by clicking on our website.
